One year ago today, a man drove a front-end loader up to the edge of a pit and the edge won. He fell seventy feet inside the cab of a machine that weighs more than his house. There was nothing exotic about how it happened — no explosion, no toxic cloud, no rare failure. Just a wheel, an edge, and the one thing that’s supposed to stand between them. Here’s the part that should stop you: that one thing is a pile of dirt, and the rule that requires it is written in exactly this death.
On This Day in Safety — August 7, 2025 · Rockland, Michigan
It was a sand and gravel pit. About as ordinary a workplace as American mining has.
On August 7, 2025, a contractor was operating a front-end loader near a highwall — the tall, cut face of earth you get when you dig a pit down into the ground. Somewhere in the routine of moving material, the loader traveled over the edge of that highwall and fell approximately 70 feet. The man in the cab did not survive.
MSHA’s fatality alert on it is four sentences long. There is no villain in those sentences — no drugs, no horseplay, no dramatic mechanical failure the agency has flagged. Just a heavy machine, an unforgiving edge, and a drop. It was the 18th mining death in the country in 2025, and the seventh that year classified as “powered haulage” — the category that covers mobile equipment moving on a mine. By the first week of August, more American miners had been killed by the equipment they operate than by anything else. That is not a fluke year. Powered haulage is the thing that kills miners.
Name it and cite it: 30 CFR 56.9300 — Berms or guardrails. For metal and nonmetal surface mines, which is what a sand and gravel pit is, the standard is blunt: berms or guardrails “shall be provided and maintained on the banks of roadways where a drop-off exists of sufficient grade or depth to cause a vehicle to overturn or endanger persons in equipment.” And the height isn’t left to taste — a berm has to be “at least mid-axle height of the largest self-propelled mobile equipment which usually travels the roadway.”
Translate it to the floor: a berm is a ridge of dirt piled along the edge of a drop. That’s it. Its whole job is to be the thing your tire hits before you go over — to catch the machine, or at least to tell the operator through the seat of his pants that he’s run out of ground. Mid-axle height matters because a berm shorter than that just becomes a ramp: the tire climbs it and the machine keeps going. The rule exists because equipment operators cannot always see the edge — dust, a load in the bucket, a berm the same color as the drop behind it, the last hour of a long shift — and the person closest to that edge is the one who pays when the dirt isn’t there or isn’t tall enough.
The relatable trigger: this is why, in these exact years, MSHA put a new rule on the books — the Safety Program for Surface Mobile Equipment, in force since 2024 — requiring mine operators to write down, with input from the miners themselves, how they identify and control the hazards of the machines that move around their site. Powered haulage and machinery had become the leading causes of death in mining, and “everybody knows to stay back from the edge” had failed enough times to become a federal rule. Add the seat belt standard, 30 CFR 56.14130, which requires belts on this class of equipment and requires that they be worn — MSHA’s own engineers have estimated three to four miners a year would live if belts were simply used. A berm and a buckle. That’s the entire technology of not dying on an edge, and it is written in the near-death and the death of people who found the edge first.
The Full EHS Picture. This is where we’re honest instead of dramatic, because not every incident is a poisoned river. (E) The environmental footprint here is small and, in MSHA’s preliminary record, undocumented as an offsite release — but it isn’t zero: a loader that falls 70 feet ruptures fuel tanks and hydraulic lines, and sand and gravel pits are frequently dug right down toward the water table, which is exactly why EPA’s Spill Prevention, Control, and Countermeasure rule (40 CFR 112) makes fuel and oil on the pit floor the operator’s problem to contain before it reaches groundwater. (H) The health impact is not a plume over a town — it is total and singular: one worker, one family, in one cab. There was no downwind community, no long tail of illness. (S) And the safety failure is the whole story — a controllable edge that wasn’t controlled. So say it plainly: this one was overwhelmingly the S. Most days the same failure hits all three at once; this day it collected the one thing that matters most and left the rest alone. A life is enough.

The machines are still winning — MSHA issued two fresh fatality alerts this week. On August 6, MSHA’s alerts landed on a pair of July deaths that read like the same warning twice. On July 6, a haul truck operator was killed when his truck collided with another haul truck at Freeport-McMoRan’s Morenci copper mine in Arizona — powered haulage, again. Then on July 11, a contract miner shoveling beneath a silo at the Bailey Mine in Wind Ridge, Pennsylvania was engulfed by falling coal spillage; he died of those injuries on July 20. MSHA classified the second as “falling, rolling or sliding material.” So what for safety leaders: two different hazards, one identical root — a person in the path of stored energy that let go. For the haul truck, MSHA is pointing at traffic patterns, following distance, and staying alert to changing conditions; for the silo, it’s the oldest rule in bulk material handling — nobody works beneath hung-up material that can release without warning. This week, walk your own two versions of these: where do machines and people share a lane, and where does anyone stand under a pile, a bin, or a chute that could run?
“Powered haulage” isn’t a mining word — it’s a warehouse and a jobsite word too. The mining data is loud right now, but the pattern travels. Forklifts, skid steers, haul trucks, delivery vans in a yard — anywhere a mobile machine and a person occupy the same ground, the machine wins ties. So what for safety leaders: you don’t need a highwall to have this problem. You need a blind corner, a spotter who isn’t there, a pedestrian route that crosses a travel lane, or a “quick move” nobody buckled up for. The mining rules are just the version written in the most blood; the lesson underneath them — separate people from moving equipment, and engineer the separation so it doesn’t depend on everyone being alert every second — is the same on a dock, a pad, or a pit.
Fail of the Day
A loader operator is building a stockpile near the crest of a pit. He’s done it a hundred times. The berm at the dump point had been there all week — but berms erode: they get driven over, rained on, pushed down a few inches at a time until one day the ridge that used to hit mid-axle is a soft, rounded hump half that height, and nobody logged the moment it dropped below the line. On this pass, he feels the outside tire find the soft edge and start to settle — that sink in the seat that every equipment operator knows and nobody forgets. He backs off, hard and immediate. The machine stays on the ground. Nothing happens.
And that’s the whole point — nothing happened. The instinct to trust the feel and get off the edge is the good catch, but read it against the top of this issue and you see the real lesson clean: the berm had quietly failed days before his tire ever found it. The system that was supposed to catch him — the workplace exam that measures the berm, the standard that says rebuild it to mid-axle height — had eroded right along with the dirt. Error is normal. Edges are normal. The fix is never “the operator should’ve been more careful next to a seventy-foot drop.” The fix is a berm that’s actually there, measured and maintained, so that being human near an edge isn’t a death sentence.

Before your next shift, take a tape measure to your edges. Every haul road, ramp, dump point, and stockpile crest where a machine can go over: is the berm at least mid-axle height of the biggest thing that travels it? Not “close.” Not “it was last month.” Measured, today. Any stretch that’s slumped, rutted, or short comes back up to height before a loaded machine runs it again — and while you’re out there, confirm every seat in every machine has a working belt and that people are actually wearing them.
